A BILL to amend article two, chapter twenty of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, by
adding thereto a new section, designated section three-a,
relating to prohibiting federally protected animals, birds or
other species from being disturbed in any manner on state-
owned property.
Be it enacted by the Legislature of West Virginia:
That article two, chapter twenty of the code of West Virginia,
one thousand nine hundred thirty-one, as amended, be amended by
adding thereto a new section, designated section three-a, to read
as follows:
ARTICLE 2. WILDLIFE RESOURCES.
§20-2-3a. Federally protected species on state property.

No animal, bird or other species, or their habitat, that is
federally protected pursuant to 16 U.S.C. §
1531 et. seq., the Endangered Species Act
; 16 U.S.C. §
668, the Eagle Protection Act
;
16 U.S.C. §
701-715, the Migratory Bird Treaty Act of 1918
;
or any
other federal act that protects animals, birds or other species,
may be relocated, removed, captured or disturbed
in any manner from
any property owned by the state of West Virginia.

NOTE: The purpose of this bill is to prohibit the disturbance
of federally protected animals, birds or other species on state
owned property.
